Terms and Conditions

1. Acceptance of Terms
These Terms and Conditions govern all services provided by Kelowna Refrigeration and Appliance Service Ltd. (“the
Company,” “we,” “us,” or “our”). By requesting, booking, scheduling, or allowing us to perform services, you confirm that
you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not
use our services.

2. Changes to Terms
We reserve the right to amend or update these Terms and Conditions at any time without prior notice. The version in
effect at the time services are provided will apply. If you do not agree with any term, your sole remedy is to discontinue
use of our services by providing fourteen (14) days’ written notice.

3. Warranty & Guarantee
All labour performed by the Company is warranted for three (3) months from the date of repair. All parts supplied by the
Company are warranted for three (3) months, excluding light bulbs, fuses, and electronic control boards. Electronic
control boards are subject to electrical fluctuations, surges, and power spikes and are installed at the customer’s sole
risk. Appliances used in commercial, rental, or business environments are excluded from all warranties. All warranties
are non-transferable.

4. Subsequent Faults
The Company is not responsible for faults or failures that occur after a repair which are unrelated to the work performed.
Our Technician will determine whether a subsequent issue is related to the original repair. If a call-out is determined to
be unrelated, standard service charges will apply.

5. Service Rates
We operate on a flat-rate service model. The service rate is $250 for the first hour, with $20 charged for each additional
10 minutes thereafter. Charges are based on time spent diagnosing and repairing the appliance, regardless of outcome.

6. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or
consequential damages, including loss of food or contents. Whilst reasonable care is taken, the Company is not liable
for damage to flooring, floor coverings, cabinetry, countertops, electrical outlets, or plumbing. All plumbing connections
are checked at the time of service; however, the Company is not responsible for leaks or failures occurring after service
completion.

7. Customer Responsibilities
The customer is responsible for providing safe and reasonable access to the appliance, ensuring utilities are functional,
and removing personal items from the appliance. The Company is not responsible for delays or incomplete service
caused by unsafe conditions, restricted access, or pre-existing defects.

8. Payment Terms
Payment is due immediately upon completion of service unless otherwise agreed in writing. Invoices unpaid after 30
days may incur a $25 administration fee. Invoices unpaid after 60 days may be referred for collection or legal action,
and the customer agrees to be responsible for reasonable recovery costs, where permitted by law.

9. Right to Refuse or Cancel Service
The Company reserves the right to refuse, cancel, or discontinue service at any time, with immediate effect, without
cause or liability.

10. Consumer Protection (British Columbia)
Nothing in these Terms and Conditions limits or excludes any rights or remedies available under the Business Practices
and Consumer Protection Act (British Columbia) or other applicable legislation.

11. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British
Columbia, Canada, and the parties submit to the exclusive jurisdiction of the courts of British Columbia.
